Terms of Service

1. Scope

These Terms of Service ("Terms") govern the use of the software-as-a-service application "Postrive" (the "Service"), operated by [PLACEHOLDER: company name, address] (the "Provider"). The Service is directed exclusively at businesses.

2. Service description

Postrive is an application embedded in Pipedrive for planning, publishing and analyzing social media posts on LinkedIn and Instagram. The scope of features follows from the current description on the pricing page. Publishing happens through the official APIs of the respective platforms (Pipedrive, LinkedIn, Meta); their availability is outside the Provider's control.

3. Conclusion of contract and trial

The contract is concluded by installing the app via the Pipedrive Marketplace and accepting these Terms. New customers receive a free 14-day trial. Continued use after the trial requires a paid plan.

4. Prices and payment

The prices shown on the pricing page at the time of ordering apply, plus statutory VAT. Billing occurs monthly or annually in advance. The Provider may change prices with 30 days' notice effective from the next billing period.

5. Customer obligations

• The customer ensures they are authorized to use the connected social media accounts.
• The customer is solely responsible for published content and ensures it does not infringe third-party rights and complies with the target platforms' terms.
• Credentials must be kept confidential.

6. Availability

The Provider strives for high availability but does not owe a specific uptime. Maintenance windows are scheduled outside usual business hours where possible.

7. Liability

The Provider is liable without limitation for intent and gross negligence as well as for injury to life, body and health. In cases of slight negligence, the Provider is liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract. Liability for indirect damages, in particular lost profits, is excluded.

8. Term and termination

The contract runs indefinitely and may be terminated by either party with 30 days' notice to the end of the current billing period. Uninstalling the app from Pipedrive constitutes termination. The right to extraordinary termination remains unaffected.

9. Data protection

Information on the processing of personal data can be found in the privacy policy.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction, where legally permissible, is [PLACEHOLDER: Provider's registered seat]. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
